Immigration and Customs Enforcement arrested Guatemalan national Walvin Victor Hugo Garcia on Friday after an appearance in Fairfax County court, according to agency officials. Garcia had been charged with rape of a child less than 13 years of age, aggravated sexual battery of a victim under 13, use of a computer to commit sex offense with a minor, and distributing drugs to a minor following his June arrest.

ICE had lodged a detainer requesting that county officials hold Garcia for federal pickup, but the agency says local authorities refused to cooperate. According to an ICE press release, sanctuary politicians declined to coordinate with immigration enforcement, and Garcia was allowed to leave court without notifying ICE. DHS has referred to the incident as a 'Sanctuary Calamity.'

Garcia first entered the United States illegally near Eagle Pass, Texas, during the Biden administration in 2023 and was released into the country, according to ICE. A Virginia immigration judge issued a final order of removal for Garcia in February 2025.
